In-country's Obligations

In order to stay updated on the University's admissions and other requirements related to representative services, it is necessary to regularly consult with the University. When performing representative services, it is crucial to act professionally and demonstrate skill, care, and diligence. Those operating In-country must make reasonable efforts to inform prospective students that they lack the authority to offer them a place on behalf of the University and should refrain from making any promises, representations, or guarantees regarding admission. Additionally, they should request and maintain an adequate supply of promotional materials provided by the University, ensuring that the most recent materials are used and that all information is accurate and up to date. Prospective students should be informed about the University's courses, fees, student experience, and accommodation options, and receive advice on entry requirements and qualification equivalents. It is essential for those operating In-country to adhere to the University's entry requirements, including English language proficiency. They should also provide accurate information about accommodation options, choices, and application processes, avoiding any misleading information or false impressions about costs, availability of part-time work, or the overall student experience at the University. While In-country representatives are permitted to display the University's logo on banners and LCD TV screens in their offices in India, any other use of the logo for promotional purposes requires approval from the designated Point of Contact. Advertising or promotional materials should be reviewed and approved by the Point of Contact before publication.

In-country must not:

  • Knowingly or recklessly make false statements about the programs or engage in conduct that could harm the University, its business, or the programs in general.
  • Claim to have the authority to bind the University or admit students to its programs.
  • Offer a place on any of the programs to applicants.
  • Collect any money owed to the University for any purpose.
  • Provide any warranties, representations, guarantees, or undertakings regarding the programs.
  • Act in a manner detrimental to the University, its reputation, or other agents.
  • Disclose or use confidential information about the University or the programs, except for fulfilling obligations under the agreement.
  • Use promotional literature or materials related to the programs without compliance.
  • Assign or subcontract any duties under the agreement.

The University's Obligations

The University shall at its expense supply In-country with such stocks of the promotional materials as agreed with the Point of Contact.

The University reserves the right at all times and at any time to make changes including (but not limited to):

  • Modifying the description and details of the courses of study as published in the prospectus (both online and in hardcopy) and other course specifications provided by the University periodically.
  • Altering the syllabuses and content of the courses of study.
  • Changing the location where the courses of study are delivered.
  • Modifying the personnel responsible for delivering the courses of study and other educational services provided by the University.
  • Modifying the qualification awarded upon completion of the courses of study.
  • Discontinuing any course of study or combining it with another course of study.
  • Adjusting the entry criteria and qualifications required for any course of study.
  • Modifying the application process and procedures.
  • Changing the designated Point of Contact.

The University shall use its reasonable endeavours to ensure the accuracy and currency of all information provided by it, whether contained in the promotional materials or otherwise, but the University gives no condition or warranty in this respect, and In-country hereby acknowledges that the University shall not be liable for any loss or damage (whether direct, indirect or consequential and whether foreseeable or not) suffered by In-country as a result of any information being incomplete, inaccurate or out of date.

The University shall consider all applications and recommendations properly submitted to it by In-country in accordance with the terms of this agreement.

The University shall have sole and absolute discretion in relation to the following decisions:

  • Whether to offer a place on any course of study to any prospective student recommended by In-country.
  • Whether to accept any prospective student as a member of the University; and/or.
  • Whether to make any offer to any student in respect of student accommodation.
  • Whether to sign contracts with prospective agents.

The University shall notify In-country of any decision to accept or not to accept a prospective student for any course of study and keep In-country up to date on agent contracts.

Shipping and Delivery Obligations

Our company, as an In-country representative, is committed to fulfilling certain obligations in our partnership with the University. These obligations include staying up to date with the University's stated admissions and other requirements for representative services. We ensure regular consultation with the University throughout the performance of our services, acting professionally, and exercising skill, care, and diligence.

In line with our responsibilities, we use reasonable endeavours to inform prospective students that, on behalf of the University, we do not possess the authority to make offers of a place to them. We strictly adhere to this guideline and refrain from making any promises, representations, or guarantees regarding the University's offer of a place to any prospective student.

To effectively promote the University, we request promotional materials from the University and maintain adequate stock levels at all times. We are committed to utilising the most recent promotional materials and ensuring that all the information we provide is up to date and factually accurate. Our aim is to inform prospective students about the University's courses of study, fees, student experience, and accommodation options.

As part of our advisory role, we provide guidance to prospective students on entry requirements and qualification equivalents. It is our duty to adhere to the University's entry requirements, including English language proficiency criteria. Additionally, we inform students about the various accommodation choices, options, and processes available to them.

Transparency and accuracy are paramount in our interactions with prospective students. Therefore, we strictly adhere to the University's guidelines and do not misrepresent any information or provide inaccurate details about the costs, availability of part-time work, or the overall student experience at the University.

In-country, we have the privilege to display the University's logo on banners and LCD TV screens at our offices in India, subject to prior agreement with the designated Point of Contact. We ensure that any advertising or promotional copy featuring the University's logo is approved by the Point of Contact before publication.

To maintain the University's reputation and integrity, we pledge not to engage in any conduct that could be deemed prejudicial to the University or its programs. We avoid making false statements regarding the programs and do not claim to have the authority to admit students to the University's programs and courses.

As part of our commitment to confidentiality, we do not divulge any confidential information about the University or its programs to third parties. We also refrain from using such information for any purpose other than fulfilling our obligations under the agreement. It is our responsibility to protect the University's interests and reputation.

We use promotional literature and materials related to the University's programs strictly in accordance with the agreement. Approval from the Point of Contact is obtained before using any promotional materials to ensure compliance.

Lastly, we undertake not to assign or subcontract any duties arising from our agreement with the University.

In-country's Obligations

The University, in return, has certain obligations to fulfil in our partnership. They undertake to supply us with the necessary stocks of promotional materials, which are provided at the University's expense. This ensures that we have the resources needed to effectively promote the University and its programs.

The University reserves the right to make changes, as necessary, to the description and details of the courses of study published in the prospectus, course syllabuses, delivery locations, personnel, qualifications awarded, and even the application process. While they strive for accuracy and currency of information, they do not provide any condition or warranty regarding the completeness, accuracy, or up-to-dateness of the information provided. However, the University acknowledges that any loss or damage incurred by us due to incomplete, inaccurate, or outdated information is not their liability.

In evaluating applications and recommendations submitted by us, the University retains sole and absolute discretion in decisions such as offering a place on any course of study to a recommended prospective student, accepting or making an offer to any student in respect of student accommodation.
